These Terms govern your use of the SellerSmart ungating tool (the "Tool"), provided by SellerSmart Ltd, company number 15870357, registered at Unit 5B Kent House, Old Bexley Business Park, Bexley, Kent DA5 1LR ("SellerSmart", "we", "us"). By purchasing, connecting your Amazon account, or using the Tool, you confirm you have read, understood, and agree to these Terms. If you do not agree, do not use the Tool.
The most important things to understand
- The Tool does not guarantee that any brand or product will be approved, or that you will be able to sell it.
- Being ungated is not the same as being allowed to sell. You are responsible for holding valid invoices and any required authorisation before you list any product.
- The Tool acts on your Amazon account automatically. Automated activity on a seller account carries inherent risk, including flags, restrictions, or suspension by Amazon.
- You use the Tool entirely at your own risk. SellerSmart is not responsible for what happens to your Amazon account.
What the Tool does
The Tool is a technical aid that works through a list of brands and, using the access you grant, attempts to obtain ungating approval on your Amazon account. Where a brand can be approved automatically, the Tool completes that approval. Where a brand requires invoices or any further documentation, the Tool does not attempt to satisfy that requirement and moves on. It does not create, submit, or alter invoices or any other documents. The number of brands opened depends entirely on your account's own history and standing, which is outside our control.
No guarantee of approval or results
Approval is determined solely by Amazon. We make no representation or guarantee that the Tool will open any particular number of brands, or that any specific product will be approved for sale. Amazon may approve, decline, reverse, or re-impose any restriction at any time and without notice.
Being ungated is not permission to sell
Being ungated removes a listing restriction only. It does not mean you are permitted to sell that product. Before listing anything, you remain solely responsible for holding valid invoices from authorised suppliers, any brand authorisation required, and for assessing each product for profitability, intellectual property and authenticity risk, and any other relevant factor. Listing products you cannot document may lead to complaints, listing removal, withheld funds, or suspension. The Tool provides no commercial, legal, or compliance advice.
Risk to your account
Connecting any third-party tool to an Amazon account, and allowing automated activity on it, carries inherent risk, including flags, warnings, restrictions, withheld or lost funds, and temporary or permanent suspension. By using the Tool you knowingly accept these risks, and to the fullest extent permitted by law you accept that SellerSmart is not responsible for any impact to your Amazon account or business. You may withdraw the Tool's access to your account at any time, which will stop it working.

SellerSmart is independent and is not Amazon. We are not endorsed by, partnered with, or affiliated with Amazon, and Amazon does not review or guarantee the Tool. Amazon and related names are trademarks of their respective owners, used here only to describe what the Tool does.
Payment, the monthly plan, and refunds
The one-time fee of £69.99 inc. VAT is payable in advance at checkout. The optional monthly rescan plan costs £29.99/month and renews automatically until you cancel; you may cancel any time and cancellation takes effect at the end of the current billing period.
If your first scan opens fewer than 300 brands, you may claim a full refund of the one-time fee within 14 days by contacting [email protected]. Beyond that guarantee, and except where a refund is required by law, fees are non-refundable, including on the basis of how many brands are approved or any action Amazon later takes. Your statutory consumer rights are not affected.
Liability
The Tool is provided "as is", without warranties of any kind to the fullest extent permitted by law. Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, funds held by Amazon, or selling privileges, and our total liability to you in connection with the Tool will not exceed the amount you paid us for it. You agree to indemnify us against claims arising from your use of the Tool, your sale of any product, or your breach of these Terms or of Amazon's policies.
Data, changes, and governing law
To provide the Tool we access certain data from your Amazon account, handled in line with our Privacy Policy. We may update these Terms, with the current version always posted here; continued use means you accept the changes. These Terms are governed by the laws of England and Wales, whose courts have jurisdiction, subject to any rights you have as a consumer to bring proceedings where you live. Your agreement
By proceeding with payment and using the Tool, you confirm you have read and understood these Terms, that the Tool gives no guarantee of approval or selling rights, that being ungated does not mean you are permitted to sell, and that you remain responsible for verifying your eligibility and documentation before listing any product. You knowingly accept the risks of connecting an automated tool to your Amazon account and release SellerSmart from liability for any account impact or loss, to the fullest extent permitted by law.
